Optixis Terms of Service & Privacy Policy

By using any services provided by Optixis Ltd, or any related services offered by our partners, you agree to comply with these terms and conditions outlined below:

 1.0 Privacy Policy  

This policy explains how we manage your personal information. We prioritize your privacy and take all necessary steps to safeguard your data. Any personal information we collect will solely be used for fulfilling your orders and will not be shared or sold to third parties. However, we are obligated to provide such information if required by law enforcement or for government investigations. We remain committed to protecting your privacy and confidentiality.

2.0 Refund & Money-Back Guarantee  

At Optixis Ltd, we strive to ensure your satisfaction. If for any reason you are not completely satisfied with our services, we offer a transparent and customer-friendly refund policy.

**Shared Hosting Refunds**  

If you’re not fully satisfied with our shared hosting service within the first 30 days after activation, you are eligible for a full refund with no questions asked. Contact us within this period, and we will process your refund within 72 hours. Should you face any issues, our team will work to resolve them within 24 hours. If you’re still unsatisfied, your refund will be processed without hassle.

**VPS Hosting Refunds**  

Our VPS hosting service comes with a 7-day no-questions-asked refund policy. If you experience any problems within the first 7 days, reach out to us, and we’ll refund you within 72 hours. We will also try to resolve the issue within 24 hours, and if still unresolved, you’ll receive a full refund.

**How to Request a Refund**  

To request a refund, please contact our customer support team via email or live chat. Provide your account details along with the reason for your refund request, and we will take care of everything promptly.

 3.0 Hacking, DDoS, and Interference  

We actively monitor network traffic and if any suspicious activities are detected, we review them closely. Hacking attempts, Distributed Denial of Service (DDoS) attacks, or any other form of interference affecting our users or services will lead to immediate suspension or termination of the responsible account. The customer will be fully liable for such activities.

4.0 Account Suspension & Termination

**4.1 Violations**  

Any content or activity that violates the DMCA, engages in illegal hacking, uses copyrighted materials without permission, spams via email, or violates our terms of service will result in immediate account suspension or termination without notice.

**4.2 Payment Failures**  

If a payment is not made by the due date, the account will be suspended within 24 hours. For shared or reseller hosting, accounts can be reactivated by paying within 28 days. For other services, reactivation is possible within 7 days. After these periods, the account will be permanently terminated.

**4.3 Data Backup & Restoration**  

We do not provide free backups after an account has been terminated. If a backup exists, a $50 restoration fee will apply. However, if you have the CloudBackup service, you can restore your terminated account within 90 days without any charges. If CloudBackup is not available, you may purchase the service for a minimum of 12 months along with hosting to avoid restoration fees, subject to approval.

**Note:** VPS and Business Mail services do not have backup options. Once terminated, data cannot be restored, even with the payment of restoration charges.

**4.4 Domain Restoration**  

Domain restoration is possible by paying the applicable domain restoration fee as per the TLD requirements, within the allowed restoration period.

**4.5 Service Suspension Rights**  

Optixis Ltd reserves the right to suspend or terminate any service at our discretion, including but not limited to:  

– If a service was mistakenly activated in your account.  

– If a service is used against any country’s law, state law, or for criminal purposes.  

– If any of our terms or offers are violated.

**4.6 Account Information**  

You must create an account with accurate information. Any changes to the email, phone number, or address must be updated within 7 working days. If you provide false information or use our services for illegal purposes, we will not be held responsible.

**4.7 Misinformation & Suspicion**  

If we find any misinformation or have any concerns regarding the validity of your information, Optixis Ltd reserves the right to suspend, terminate, or permanently close your account.

**4.8 Legal Cooperation**  

Optixis Ltd adheres to the laws of Bangladesh and will cooperate with law enforcement agencies as required by law.

**4.9 Service Cancellation**  

If a customer cancels their service, all data will be permanently deleted from our live and backup servers. This means we cannot provide a backup after service cancellation, even if you had a paid backup service.

– **Reseller Hosting**: Optixis offers reseller hosting for individuals or businesses who wish to resell hosting services. This service includes private label options, robust control panel access, and the flexibility to manage multiple client accounts.

– **Web Hosting**: Optixis provides reliable, secure, and fast shared and cloud-based web hosting solutions. These services are perfect for businesses, personal websites, and blogs, offering easy-to-use management tools and outstanding uptime.

– **Domain Registration**: With Optixis, you can register a wide range of domain names (TLDs) with complete management tools. We provide full control over your domain’s DNS settings, transfer options, and renewals.

**3. Account Registration and Responsibility**

– **Account Creation**: To use Optixis’ services, you must create an account. You are responsible for providing accurate and complete information during registration. Any fraudulent or false information may result in the suspension or termination of your account.

– **Account Security**: You are solely responsible for the security of your account. Ensure that your login credentials are kept confidential. If you suspect unauthorized access to your account, please contact us immediately.

– **Client Responsibility**: You agree to use Optixis’ services only for lawful purposes. You are responsible for all activities that occur under your account and must comply with all applicable laws, regulations, and industry standards.

**4. Payment Terms**

– **Pricing & Billing**: Optixis offers several payment plans based on the services you choose. Payments for our services are required upfront, either on a monthly, quarterly, or annual basis. All payments are to be made in full, and you are responsible for keeping your payment information up-to-date.

– **Late Payments**: Failure to pay for services on time may result in service suspension or termination. Optixis reserves the right to charge late fees for overdue payments.

– **Refund Policy**: Optixis offers a 30-day money-back guarantee for most services. Please refer to our **Refund Policy** for further details about eligibility and exceptions. Domains, custom configurations, and certain add-ons are non-refundable.

**5. Service Availability and Uptime Guarantee**

– **Uptime Guarantee**: Optixis guarantees 99.9% uptime for all hosting services. This guarantee excludes planned maintenance, network failures beyond our control, and force majeure events. We aim to provide the highest reliability possible.

– **Maintenance & Downtime**: Optixis will notify you in advance of any planned maintenance that may affect service availability. Emergency maintenance will be carried out as needed, and efforts will be made to minimize any service interruptions.

**6. Service Suspension and Termination**

– **User Initiated Termination**: You may cancel your Optixis services at any time by contacting our support team. No refunds will be issued for services already rendered.

– **Optixis Initiated Suspension or Termination**: Optixis reserves the right to suspend or terminate your services without notice if we suspect any violations of our Terms of Service, including but not limited to fraud, abuse, or illegal activity.

**7. Acceptable Use Policy**

– **Prohibited Uses**: Optixis services may not be used for illegal activities, spamming, or any activity that interferes with our network’s performance. You must not use our services to engage in any unlawful conduct, including but not limited to phishing, hacking, or distributing malicious software.

– **Content Management**: You are fully responsible for the content stored, transmitted, or published via your hosting account. Optixis does not actively monitor content but reserves the right to remove any content that violates our policies.

**8. Data Privacy and Security**

– **Data Protection**: Optixis is committed to safeguarding your personal data in accordance with privacy laws. We will not sell or rent your data to third parties. Please refer to our **Privacy Policy** for more information on how your data is handled.

– **Security**: While we take all necessary precautions to protect your data, Optixis is not responsible for any unauthorized access to your account caused by external breaches or vulnerabilities outside of our control.

**9. Limitation of Liability**

– **No Liability for Damages**: Optixis is not responsible for any indirect, incidental, special, or consequential damages resulting from your use of our services, including data loss, service interruptions, or any third-party claims.

– **Maximum Liability**: In any event, the maximum liability of Optixis, whether in contract, tort, or any other theory, shall not exceed the fees paid for the service(s) in question during the previous 12 months.

In cases of fraud investigations or violations of our Terms of Service, we may retain your data for longer periods for security purposes.

**7.5 Communication and Marketing**  

Optixis may contact you regarding the services you have subscribed to, including billing updates or service information. We may also send you promotional content about new services or offers if you have opted in to receive marketing emails. You may unsubscribe at any time. Communication with customers is primarily done through email, SMS, and push notifications. Optixis does not offer customer support through non-authorized channels.

**7.6 Sharing of Non-Personal Data**  

We may share aggregated statistical data regarding our customers’ usage of services with third-party partners, such as advertisers or suppliers. This information will not include any personal data and will be shared solely for analytical or promotional purposes.

**7.8 GDPR Data Processing Agreement**  

By using our services and agreeing to our Terms of Service, you are automatically accepting our GDPR Data Processing Agreement (DPA). There is no need to sign a separate agreement. If you require a copy of our DPA, you may request it by contacting us at **abuse@optixis.com**.

**7.9 Age Restrictions**  

Our services are not intended for minors under the age of 18. We do not knowingly collect personal data from individuals under 18 years old. If a minor uses our services, it must be with the permission of their parent or legal guardian.

### **8.0 Offer and Affiliate Abuse**

**8.1 Abuse of Promotional Offers**  

Occasionally, Optixis offers special promotional deals for new customers. Existing customers attempting to cancel their services to take advantage of such offers will be deemed to have abused the system. Any such activity, including manipulating offers to receive discounts, will result in the immediate cancellation of the order. Accounts involved in such abuse will be terminated, and no refunds will be provided.

**8.2 Affiliate Program Abuse**  

Optixis’ affiliate program is designed to reward legitimate referrals. Users are prohibited from using their own affiliate links to purchase services for personal use. Affiliate commissions will be invalidated if we detect such behavior. Affiliates should only share their links through approved channels, such as blog posts, landing pages, or video content. Abuse of affiliate links (e.g., sharing through spammy environments) may result in suspension from the affiliate program.

### **9.0 Suspension & Termination Rules**

**9.1 Web Hosting Suspension and Termination**  

If a customer fails to make payment by the due date, their account will be automatically suspended. We offer a grace period of 27 days to resolve outstanding payments. If payment is not made, the account will be terminated, and data may be lost. Restoration requests can be made within 90 days, subject to a $50 fee.

**9.2 Suspension Due to Abuse**  

Accounts involved in the following activities will be immediately suspended:

– Sending bulk emails or spam from hosting accounts.

– Overuse of server resources without upgrading to a higher plan.

– Engaging in illegal activities or violating our Terms of Service.

– Violating our fair usage policy or engaging in other abusive behaviors.

Suspended accounts may be permanently terminated if the abuse is severe or ongoing.

 

9.3 Hosting Abuse Termination

 

The following actions will lead to the immediate termination of the user’s account due to abuse:

 

– Hosting phishing links, scripts, or content related to drugs, pornography.

– Any activity on the user’s website that violates international laws or their local ICT laws, potentially leading to account termination (this may also result in temporary suspension for legal investigation).

– Spreading hate or conflicts between nations, religions, societies, or communities using our services.

– Engaging in payment fraud or card fraud will lead to immediate service termination.

– Scamming or spamming using our services is strictly prohibited.

– We strongly prohibit anti-government activities, cryptocurrency activities (for restricted countries such as Bangladesh), money laundering, or any financial scams. Engaging in such activities will result in immediate permanent account termination without any prior notice. No data will be provided to the user in case of such abuse termination, and the user agrees not to request any backup data.

 

 

### 10.0 Cancellation Policy

 

#### 10.1 Hosting Cancellation

Users can cancel their hosting services at any time by submitting a cancellation request through our client area. There will be no cancellation fees for the standard cancellation process. If the user wants a refund after cancellation, they need to create a support ticket with the billing department for processing the refund. The billing department will review if the user’s cancellation is eligible for a refund based on our money-back guarantee and refund terms. If eligible, we will issue a refund. If not, the refund request will be denied.

 

 

### 11.0 Fair Usage Policy

 

A Fair Usage policy is in place to ensure all Optixis users receive the quality of service they paid for, without negatively affecting the experience or performance of other users. Please refer to our Fair Usage Policy for more details.

 

 

### 12.0 DMCA Notice

 

Optixis is a DMCA (Digital Millennium Copyright Act) compliant service provider that respects copyright ownership and reviews every valid DMCA Notice. Upon verification of the DMCA notice, we will attempt to contact the reported website owner and give them time to remove the reported content. Repeated instances of copyright infringement or failure to act on the notice may lead to account suspension or termination.

 

13.0 Hosting Guidelines

 

Users must ensure that they do not host any illegal or unlawful content in compliance with the laws of the user’s country, the target audience’s countries, or the laws of Bangladesh (where Optixis originated). Users are prohibited from hosting or selling the following items on their websites or servers:

 

– Firearms or related accessories

– Pornography

– Adult services

– Highly regulated substances such as alcohol, tobacco products, marijuana, cannabidiol (CBD), LSD, and other cannabis-related products

– Gambling or related products

– Content or files that infringe on copyright or intellectual property rights

– Money exchange or cryptocurrency exchange sites without government authorization

– Malware, spyware, adware, spam, or any malicious materials, content, or codes

– Impersonating another person or entity

– Inciting violence or making threats

– Posting private information without consent

 

Please note that these guidelines are intended to provide guidance, but their interpretation and application are at the sole discretion of Optixis. These terms are not exhaustive and may be modified.

 

Failure to comply with these guidelines can result in immediate account suspension or permanent termination without prior notice, and no data backup will be provided in such cases. If you believe any user has violated these guidelines, please report it by emailing **abuse@optixis.com**.

 

14.0 Support Policy

 

#### 14.1 Respectful Interaction

We believe in mutual respect between users and our support operators. Any form of abusive behavior, including offensive language through support tickets, live chat, phone calls, or other means, will not be tolerated. Optixis reserves the right to gather evidence of such behavior and suspend or terminate services (either temporarily or permanently) without notice. Legal action may also be pursued if necessary.

 

14.2 Custom Service Requests

Customers may request services not explicitly mentioned on our website or advertisements. We will consider such requests and may approve them based on management’s discretion. Additional fees may apply for these services. If, after providing the service, Optixis determines that maintaining it is no longer feasible, we reserve the right to terminate the service without notice. In such cases, the user may be given up to 7 days to migrate the service elsewhere, depending on Optixis’ discretion.

 

 15.0 Backup Policy

 

 15.1 Backup Services

Optixis offers paid automated backup services for hosting and VPS servers. These services ensure regular backups are created and stored on dedicated cloud backup servers. Standard hosting and VPS packages do not include backup services unless specifically mentioned. The backup service provides daily backups for a specified period.

 

 15.2 Backup Terms

Once the customer orders a backup service, backups will be automatically created within 24 hours of activating the backup service. Backups will be created once a day, and any changes made by the user after the daily backup may not be recoverable. Shared hosting cloud backups allow users to restore backups up to 3 months in the past, while VPS backups are available for the last 5 days. Users are responsible for maintaining separate copies of their backups on local storage or other external locations to avoid potential data loss.

 

17.0 Migration

 

New users can avail of one free website migration (cPanel to cPanel) within 30 days of purchasing a hosting plan. After 30 days, migrations will incur a one-time fee of $10 per website, which is non-refundable. The user must provide the previous hosting login details (cPanel, sFTP/FTP, CMS) via a support ticket. Optixis will complete the migration within 24 hours, depending on the website size and complexity. The previous hosting service must have sufficient storage to create the website backup. If a refund is requested, the refund policy (section 1.5) will be applied.

 

 

18.0 Pre-Expiration and Post-Expiration Notices

 

For domain names, we send pre-expiration and post-expiration notices via email. The first notice is sent 15 days before the domain’s expiration, the second notice 10 days before expiration, and the third notice on the expiration day. The fourth and fifth notices are sent 15 and 28 days after the domain expiration. For other services, the first pre-expiration notice is sent 15 days before the service expires.

 

By agreeing to the Terms of Service and Privacy Policy, users also accept all linked policies, including the Money-Back Guarantee & Refund Policy, Affiliate Terms, Abuse & Handling Policy, and Fair Usage Policy.
